Ian is a partner in our firm’s litigation
group. Ian has served on our firm’s legal
personnel committee and is actively involved in
our student recruitment and mentoring programs.
In his 20 years of litigation experience, Ian
has acted as counsel on numerous types of
matters including commercial landlord and tenant
disputes including commercial rental rate
arbitrations, commercial and residential real
estate litigation, construction disputes, estate
litigation, the prosecution and defence of
professional negligence claims, international
litigation including jurisdictional disputes,
mortgage enforcement and remedy matters,
shareholders’ disputes, environmental
litigation, warehouseman disputes and collection
matters.
Ian has achieved marked success for clients
both on trials before the Ontario Superior Court
of Justice and on appeals before the Ontario
Court of Appeal.
One of Ian’s most public cases was on behalf
of a real estate developer who was seeking to
acquire a landmark development property from a
government body which had improperly by-passed
our client and had committed to sell it to
another party. The case was reported widely in
the press and even became the subject of debate
in the provincial parliament. Although the
government body had never signed an agreement to
sell the property to our client, following
various contested proceedings, our client
succeeded in acquiring the property on very
favourable terms.
Ian’s clients include real estate developers,
commercial landlords, commercial tenants,
financial institutions, custom home builders,
real estate agents, property managers, and
various manufacturers, wholesalers and retailers.
Ian has presented numerous in-house seminars
to property manager clients on commercial
landlord and tenant issues and to financial
institution clients on topics such as the
enforcement of personal guarantees. Ian is also
a regular roundtable leader at the annual
International Conference of Shopping Centres law
conference in Toronto, where he presents and
discusses topics relevant to retail landlords
and retailers.
When not in the office, Ian contributes to
minor sports in the community. He has served as
a coach or manager for minor hockey, baseball
and soccer teams.
